SCOTTSDALE, AZ (3TV/CBS 5) — A Scottsdale woman is facing a felony charge after investigators said she lied that a 2-year-old child was with her grandmother just so the girl would stay away from her father.

According to court paperwork, Cassie Cherry claimed the girl was given to her grandmother, who took her to North Carolina around Nov. 20. At the end of that month, a judge ordered Cherry to bring the toddler back to Arizona by Dec. 1 so she could be with her father. During the court hearing, the supposed grandmother phoned in and said the girl would be returned.

But the deadline came and went and the girl wasn’t back in Arizona. Cherry was found in contempt and taken into custody. A few days later, court paperwork said Cherry told investigators she didn’t know where the girl was and couldn’t get ahold of the grandmother. The court did and told the “grandmother” she needed to meet the father at the closest police station in South Carolina.

But that didn’t happen. On Dec. 6, the grandmother called into the court, told them the girl was with her and that she didn’t care for Cherry’s tone during the hearing, didn’t want to talk about it and hung up. The court thought the grandmother was disobeying officials, so Cherry was released from custody. She gave the father possible addresses, states and people the girl could be with, which investigators later found out were all fake.

Detectives said they later found out the “grandmother” was Cherry’s acquaintance and this was all a plan to keep the 2-year-old from her father. Court records said it wasn’t the first time she had done this, claiming multiple times the father had sexually assaulted the girl. Those claims were also made up, according to the paperwork.

Cherry was arrested on Jan. 5. Police said on Wednesday the girl is believed to be in Connecticut but didn’t say where.
